Part one. 

Where are you from and with what passport? 

 

  1. I am an EU citizen and I have an EU passport. I want to work in the Netherlands!

  1. And if I have a residence permit in the EU, but do not have an EU passport. Can I work in the Netherlands?

It all depends on whether your residence permit has a stamp with a work permit. If not, then first you will need to get this permission. Then find an employer that will send you to work in the Netherlands.

 

  1. I am from the EU, I live in Estonia (or Latvia), I have a non-EU passport. What do I need to do to work in the Netherlands?

 

Your rights are equal to those of long-term residents in the EU. First, you need to get this status. With it you can get a residence permit and a work permit. Without these documents, you cannot work in the Netherlands.

 

  1. I have a residence permit in the Netherlands - can I start working immediately?

It depends on what is on your card. If you have a residence permit with the right to work without restrictions, and the card contains the inscription: “Arbeid vrij toegestaan, TWV niet vereist”, then you can work at any job. But the entry on the card implies restrictions, first you need to obtain a work permit in the Netherlands. This can only be done by your employer. Visa-free entry only entitles you to entry without a visa, but does not entitle you to work in the Netherlands. You can only come as a tourist. Part two.

What should I do if I have neither a residence permit nor an EU passport? How can I start working in the Netherlands? 

 

It is possible to obtain a residence permit for work in an IP only for high-class specialists and some exceptional categories. Simple working specialties do not provide such an opportunity.

 

But I heard that you can come with a Polish or other visa? This is true?

 

Yes, there is such a way.

To begin with, you can find an employing company that will give you a residence permit in one of the EU countries, or independently obtain an entrepreneur visa in any EU country.


Work Visa. 

 

When you apply for a job in the Netherlands, there will be 3 participants.

  1. Sending side.

 

A company in the EU (subcontractor), which will issue you a residence permit in the EU, will receive an A1 form for you and send you to work in the Netherlands. \

 

  1. The host.

A company in the Netherlands that has a contract with the Sending Party and accepts you to work in the Netherlands. In this case, you have the right to work only at the agreed facility.

 

  1. You are an employee.

You will be tied to both the Sending and Receiving sides. You cannot work outside this chain.

 

For example, if a Polish company hired you and issued you a residence permit in Poland, this company can send you to the Netherlands. You will be tied to the company that sent you for as long as you work in the Netherlands.

You will be able to work in the Netherlands for 3 months, after which you will have to leave the country for 3 months, then you can return again.

 

But remember that even if you already have a work visa in Poland and have an A1 form, you will not be able to look for a host in the Netherlands on your own, without the participation of your employer you will not be able to register yourself.


Entrepreneur visa

 

If you come on an entrepreneur visa, then you yourself are the employer who sends the employee - yourself.

 

Here, as in the previous case, you need a Host in the Netherlands - the place where you will go to work. And you and the Receiving Party must have a contract.

 

Documents

 

In order for the employee to be able to go to the Netherlands for 3 months officially, it is important that the Receiving and Sending parties draw up all the necessary documents between themselves and comply with all conditions.

The employer must issue Form A1 in the country where the employee has a residence permit.

Also, the employer must have a formal contract with the Host.

An employee's salary must not be lower than the minimum wage in the Netherlands.

A timetable must be maintained.

The employee must have insurance.

The worker must have this entire set of documents at the workplace every day, because the Labor Inspectorate can come to check at any time.

It is important to understand: 

  1. Working as a business traveler in the Netherlands, you will not receive a residence permit in the Netherlands.
  2. You can't bring your family here.
  3. You will have to leave in 3 months.
