Temporary and non-temporary purposes of stay in the Netherlands

You always come to the Netherlands with a specific purpose. For example, you want to live with your family or immigrated to work or study. The reason for your stay is the purpose of your stay. The purpose of stay may be temporary or permanent.

With a temporary residence permit, you can stay in the Netherlands for a limited time. You can't renew some residence permits on a temporary basis. If you have a temporary residence permit, you also cannot apply for a permanent residence permit or Dutch citizenship.

The following purposes of stay are temporary:

• An adopted or adopted child whose parent has:

1. Temporary residence permit;

or

2. Temporary asylum permit;

• Pending a request in accordance with section 17 of the Dutch Citizenship Act;
• Au pair;
• Cross-border services;
• Medical treatment;
• Intra-corporate translation (Directive 2014/66 / EU);
• Trainee and Practitioner and YWEP (Work Training);
• Seasonal work;
• Education;
• Exchange (work leave or cultural exchange);
• Stay with your family or family member. The family member you are staying with has - a temporary residence permit or
  – permission for temporary asylum.

• Stay with a minor Dutch child;
• Orientation year (after training);
• Residence in accordance with the decision of the Secretary of State, provided that the decision specifies that the right of residence is temporary.

Permanent purposes of stay:

With a temporary residence permit, you can stay in the Netherlands indefinitely. You must continue to meet the conditions for obtaining a residence permit. You can apply for a permanent residence permit if you meet the conditions.

The following purposes of stay are not temporary:

• An adopted or adopted child whose parent has:

1. Dutch citizenship;
2. EU / EEA or Swiss citizenship;
3. Has a permanent or indefinite residence permit in connection with obtaining asylum;
4. Has an ordinary residence permit for a non-temporary appointment;

• Work as both underprivileged military and underprivileged civilian personnel;
• Paid work;
• Private enterprise;
• Foreign investor (wealthy foreigner);
• Economically inactive long-term resident of the EU;
• Long-term resident of the EU;
• Holder of the European Blue Card;
• Highly skilled migrant;
• Temporary humanitarian grounds;
• You stay with a family member or relative. The family member you are living with has:

1. Dutch citizenship;
2. EU / EEA or Swiss citizenship;
3. Has a permanent or permanent residence permit in connection with asylum;
4. Has an ordinary residence permit for a non-temporary appointment;

• Residence in accordance with the decision of the Secretary of State, provided that the decision states that the right of residence is not temporary.
• The stay under the Withdrawal Agreement for the (relatives) of the British is not in all cases temporary. You present this right of residence together with your residence document and not with your residence permit.
