On October 14, an excellent news for Ukrainians: the Temporary Protection Directive (Richtlijn Tijdelijke Bescherming, RTB) has been extended until March 4, 2024. This decision was taken by the European Commission. In addition, IND is changing the sticker procedure for Ukrainian refugees who arrive in the Netherlands after 31 October.
Another year in the Netherlands
With the extension of the EU Directive on temporary protection, the right to stay in the Netherlands for another year is given to citizens of Ukraine, persons with a permanent residence permit in Ukraine, and persons with refugee status in Ukraine.
Dealing with the issue of third-country nationals
In the state register of personal data (Basis Registratie Personen, BRP) got 6600 refugees from Ukraine without Ukrainian citizenship. Most of them have a temporary residence permit in Ukraine, for example, for work or study. And this group of persons after March 4, 2023 will no longer be subject to temporary protection.
Important! In addition to Ukrainian citizens, the right to temporary protection is reserved for persons:
- with a permanent residence permit in Ukraine;
- with refugee status in Ukraine.
The procedure is not through Ter-Apel
The Government has authorized the Refugee Service (VluchtelingenWerk) to inform third-country nationals that their period of temporary protection is about to expire. They will be told how to apply for a residence permit in the Netherlands in other ways, how to get help and return to their home country (origin).
As the Netherlands is experiencing one of its most serious migration crises in recent history (at the refugee reception center in Ter Apel, asylum seekers were forced to spend the night in the open), for third-country nationals who came from war-torn Ukraine, they will develop a special procedure for considering requests for a residence permit. IND is still working on what it will look like.
Pasting stickers after November 1
Currently, a sticker (a sticker in the passport, which confirms the legality of residence in the Netherlands on the basis of temporary protection) can be obtained in one of three locations IND in the Netherlands. Will work after November 1st only one fixed location in Amsterdam. Therefore, refugees arriving in the Netherlands after October 31, 2022 (including children over 14 years of age) will only be able to request a sticker via pre-registration there.
