Netherlands tightens controls on foreign service providers

From March 1, 2020, a mandatory requirement for electronic registration is introduced for foreign employers and self-employed persons operating in the Netherlands.

It's not a secret for anyone that people from the countries of the post-Soviet space widely use the loopholes of migration legislation to carry out labor activities in the Netherlands.

The number of advertisements of intermediaries providing services for the issuance of "business trip" Polish or other European visas is incalculable. At the same time, the number of entrepreneurs staying in the Netherlands on a “business trip” is also increasing.

It is this group of people that will be affected by the legislative changes introduced from March 1, 2020.

  1. Who is the overseas service provider?

You are a foreign service provider if you:

1.1. as a foreign employer, temporarily:

– you come to the Netherlands with your staff to perform maintenance;

– you send employees to a company branch in the Netherlands;

1.2. are a foreign employment agency and temporarily provide employees to work in the Netherlands.

1.3. self-employed and looking to come to the Netherlands for temporary work

 

  1. What tightening requirements are being introduced?

As a foreign service provider, before starting to carry out activities in the country, you must inform, among other things:

  • Requisites / Legal data of your company;
  • Applicant's personal data;
  • Personal data of all employees involved in the provision of services;
  • Requisites / details of the contact person in the Netherlands;
  • The field of activity in which you will be working in the Netherlands.
  • Customer data in the Netherlands;
  • The address of the actual provision of services;
  • Estimated period of service provision;
  • Information on the composition of persons sent to perform work on the territory of the Netherlands;

These requirements apply to the following activities (sectors of the economy):

  • building;
  • cleaning of premises
  • food industry;
  • metalworking;
  • maintenance and care
  • washing windows
  • agriculture and gardening.
