For example, if the annual income is 80000 and the deductions are 2000, then in the first case it will turn out (80000-2000) * 70% = 54600, and if you do the opposite, then 80000 * 70% -2000 = 54000. It turns out that I overpay tax on the difference of 600 euros. Is it possible to recover this overpayment? The employer answered this question that he always did this and would not change anything. Is he right? Are there any legal provisions that govern the application of taxiing?

Alas, in this case, the employer is right, pension contributions are not income, so they are deducted from the full amount. They will become income the moment you receive them. In addition, this calculation is not done manually by the employer, but with the help of a program that is developed taking into account all the rules and regulations. Therefore, even if the employer wanted to meet you halfway, he could not do it.
