Fraud claims filed with the tax authorities (Belastingdienst) of the Netherlands are not and will not be considered in the foreseeable future. Representatives of Belastingdienst say they will consider all such applications later - but do not indicate the timing. During this time, the tax authorities have accumulated about 25 thousand applications.
The reason for this strange behavior of Belastingdienst is in compliance with the law. In early 2022, the tax authorities were fined €3,7 million for using the Fraude Signalering Voorziening (FSV) system for recording such claims. Since 2020, it has become known that this system does not comply with privacy laws and the use of personal data. As a result, 27 individuals and legal entities were illegally listed as potential scammers. It was for this violation that the court fined Belastingdienst.
Naturally, the tax authorities stopped using FSV. However, the temporary signaling system (Temporary Signaling Facility, TSV), which was supposed to replace it, is also not yet ready and does not comply with the law. The government has so far banned the introduction of TSV. The tax authorities have no choice but to shelve the consideration of applications ...
What can I do to get my application started right away?
In order for the tax fraud claim to be processed immediately, instead of Belastingdienst, file it with the Fiscal Intelligence and Investigation Service (Fiscale inlichtingen- en opsporingsdienst, FIOD). This organization uses a different IT fraud reporting system that has been found to be compliant with the law.
