For the British in the Netherlands, the period of obtaining a residence permit under a simplified procedure - the so-called Brexit Residence Permit. From October 1, 2022, the Migration Service tightens the rules. Failure to apply by September 30th will result in illegal residence.
Status of British citizens in the EU
As we wrote in our review, Brexit - the exit of the United Kingdom (UK) from the European Union (EU) on January 31, 2020 - has brought many changes for businesses and individuals. After Brexit, a UK citizen is no longer an EU citizen. However, the UK and the EU have reached an agreement ensuring that British citizens can continue to live, work and study in the EU. To do this, you must apply for a residence document.
Conditions for obtaining a Brexit residence permit in the Netherlands:
- British citizenship or the status of a family member of a British citizen (family relationship already existed before 1 January 2021);
- living in the Netherlands until 31 January 2020 or moving to the Netherlands after 31 January 2020 but before 1 January 2021
Types of residence permit for the British:
- Temporary residence permit - issued to two categories of persons: 1) British citizens who have lived in the Netherlands for less than five years; 2) British family members who came to live in the Netherlands as part of the family reunification procedure.
- Permanent residence permit - issued to British citizens who have lived in the Netherlands for more than five years.
Deadlines for processing documents
In the Netherlands The Brexit residency application period for Britons has ended on October 1, 2021. However, it turned out that not all Britons applied for a residence permit. The Migration Agency (IND) has decided to extend the transition period for British citizens in the Netherlands. Late applications will continue to be considered.
What happens after October 1st?
If the application is not submitted before October 1, then in order to obtain a residence permit for Brexit (according to a simplified procedure), you will have to bring valid reasons for being late. In the absence of such reasons, the only option left for legal residence in the Netherlands is to apply for Residence permit under the usual procedure (which applies to all foreigners except EU/EEA and Swiss citizens).
