Ukrainian citizens and residents who arrived in the Netherlands fleeing the war can exercise the right to temporary protection. Status of Ukrainians in the Netherlands

The status of Ukrainian refugees in the countries of the European Union, including the Netherlands, is determined Directive on the activation of the temporary protection regime (Directive No. 2022/382 of 04.03.2022/XNUMX/XNUMX). Such a regime is provided for by Directive No. 2001/55 / ​​EC of 20.07.2001, but has never been used during the 21st year.

 

In each EU state, the registration of the status of a person under temporary protection has its own differences. The Netherlands decided to use the asylum procedure for this. But the procedure is "frozen" at the stage of applying for asylum. I.e Ukrainians have the right to stay in the Netherlands on the same grounds as refugees during the consideration of their requests.

 

On this basis, Ukrainians in the BRP registry are now assigned the code 30as for asylum seekers from other countries. But the peculiarity of the status of Ukrainian refugees is that they are allowed employment, while the rest of the asylum seekers do not have the right to work until a decision is made on their issue. So, code 30 does not quite correspond to the status of Ukrainians.

 

What is code 46?

Code 46 indicates that the Temporary Protection Directive has been applied to the registrant. This Directive, in particular, ensures that the person concerned can await a decision on his application for asylum in the Netherlands. And most importantly - during this period of waiting paid employment allowed.

 

In this case, many Ukrainians are already registered with BRP with residence permit code 30. Registration under this code was a temporary measure in order to legalize the stay of Ukrainians fleeing the war in the Netherlands. Code 30 will be automatically changed to code 46 over the weekend of May 14th and 15th. For Ukrainians who will register with BRP, starting from May 12, code 46 will be used.
