The Dutch government has facilitated the official employment of Ukrainian refugees

 

On March 30, 2022, the Dutch Ministry of Justice and Security published important letter regarding the reception of Ukrainian refugees. This document, in particular, facilitates the access of Ukrainians under the temporary protection of the Netherlands to the labor market.

 

The letter noted that although the primary focus is on providing Ukrainian migrants with quality housing, access to work is no less important. According to the current rules, in order to hire a foreigner, the employer must first obtain special permission from the authorities that control migration and the labor market. At the same time, the employer must give preference to residents of the Netherlands and other EU countries. Now an exception has been made for Ukrainian refugees - the employer has the right to hire them without special permission. Moreover, the rule introduced from April 1, 2022 has a retroactive effect: employers who have hired Ukrainian refugees from March 4, 2022 illegally will be released from liability if they inform the labor market control authorities of this within the prescribed time frame.

 

Changes in employment rules for Ukrainians under temporary protection of the Netherlands 

With regard to residents of Ukraine who have received a temporary residence permit in the country, the rule of looking for workers first in the Netherlands and then in other EU states does not apply. That is, provided that the Ukrainian worker suits the employer, he can be hired immediately, without issuing a special permit. Those employers who have hired Ukrainian refugees illegally since March 4, 2022 will also be released from liability.

 

An employer hiring a Ukrainian refugee is obliged to notify the employment control authority (UWV) of this two days before the start of his employment duties. Ukrainians illegally hired from March 4, 2022 can be legalized until April 15, 2022. After April 15, 2022, employers who fail to comply with the requirement to report UWV in a timely manner will be fined.

 

First of all, an exception to the general EU rules on the employment of foreigners is made for Ukrainians who want to work for hire. It is the receipt of wages that guarantees a high degree of economic security for refugees who, by their very status, are in a vulnerable group of the population. The legislation of the Netherlands clearly guarantees the rights of employees (minimum wage, safe working conditions, etc.).

 

For self-employed persons, the rules are more complex. Such persons must independently provide for themselves the income necessary for living, as well as make contributions to the pension fund and the accident insurance fund. Not everyone manages to cope with this, therefore, at this stage, Ukrainian refugees cannot register as self-employed persons. It is assumed that such an opportunity will be provided to them later, but no specific dates are given.

Rules for the employment of Ukrainian refugees

An employer has the right to hire a refugee from Ukraine, provided that he has a temporary residence permit in the country. This document is issued in the municipality where you live. When obtaining a permit, a refugee is entered in the register (BRP), recorded in the immigration service (IND) and receives an individual tax number (BSN).

 

Due to the fact that the number of Ukrainian refugees is large, the municipal authorities do not have time to issue them residence permits quickly, therefore, a transitional period has been introduced for the employment of such refugees - until May 31, 2022. Before this date, immigrants from Ukraine can be employed in the Netherlands on the basis of a passport confirming the citizenship of Ukraine. Refugees from Ukraine who do not have Ukrainian citizenship can be employed in the Netherlands on the basis of a residence permit in Ukraine valid as of February 23, 2022 or a document confirming that Ukraine has granted refugee status. It is possible that the transition period will be extended.

 

The second prerequisite for employment is that a native of Ukraine has a bank account. To ensure that employers do not violate the rights of workers in relation to the minimum wage, the payment of wages in cash is prohibited in the Netherlands. Earned money must be transferred to a bank account. So the government can control the implementation of the established rules by the employer.

The letter from the Dutch Ministry of Justice and Security also allows refugees from Ukraine to do unpaid volunteer work and work internships while studying.

 

Control over compliance with the rules for employment of residents of Ukraine under the temporary protection of the Netherlands is assigned to the labor inspectorate. It is assumed that later a special body will be created to facilitate the search for work and employment for Ukrainian refugees. The specific time frame for the creation of this body has not been determined. Due to the fact that exceptions to the general rules for the employment of foreigners made for Ukrainian refugees were introduced in a hurry, in the future it is possible to adjust the rules for hiring Ukrainians to work in the Netherlands.

 

So, for legal employment in the Netherlands, a refugee from Ukraine needs:

 

  • Have grounds for obtaining temporary protection in Dutch territory.
  • Get an individual tax number. Until May 31, 2022, employment without registration is allowed.
  • Open a bank account to which the salary will be transferred.
  • And of course, find an employer who is ready to hire a Ukrainian. The employer must report the employment of a refugee to the regulatory authorities 2 days before the employee begins to perform duties.

 

Registration of labor activity as a self-employed person is not yet possible.

Readers of the article often ask the question that the information contained in it differs from the requirements of Dutch law. The letter from the Ministry of Justice and Security contains information that such discrepancies may indeed exist, due to the urgent need to admit refugees from Ukraine to the labor market. Discrepancies in various legislative acts will be eliminated later.

In accordance with paragraph Documenten, Section III of the letter of the Ministry of Justice and Security dated March 30, 2022, Ukrainian refugees can be employed before they receive a temporary residence permit. The previous paragraph of the letter says that the BSN for refugees is issued simultaneously with a temporary residence permit in the Netherlands.
