Obtaining a business visa
If you are planning to open your own business in the Netherlands, then you can apply for an entrepreneur visa or, as it is also called, a business visa.
To obtain it, you will have to work hard: prepare your entrepreneurial dossier and draw up a serious business plan. These documents will have to convince the migration service of the viability of your business idea and the ability to generate income not only for you, but also for the country's economy.
Initially, you fill out an application, which is considered by the RVO (Rijksdienst voor Ondernemend Nederland), which works with entrepreneurs. It is then transferred to the IND, the Dutch migration service, which makes the final decision. The Migration Agency makes its choice based on the points you score on a certain scale. To obtain a business visa, you need to score 90 points. The point scale consists of three parts: A, B and C.
Part A concerns directly the entrepreneur himself, his experience, education, etc. Part B is essentially your detailed business plan, the rationale for your business idea. Part C determines the value of your future business for the country's economy.
After filing an application, the RVO may request additional documents. Providing them is optional, but may result in a negative recommendation if the request is ignored. However, upon receipt of a refusal, you can file an appeal and provide additional documents in the process. This point can be advantageous, since in case of refusal, the IND explains the reasons, and documents can strengthen precisely those moments that seemed weak during the initial consideration.
In this process, as in many others, when doing business in the Netherlands, competent and well-grounded self-presentation is very important. The Immigration Office needs to be sure that you are really going to do business and that it will be viable. You must prove that you are an expert in your chosen field. It is difficult to do without the services of a migration lawyer here, since it is important for you to prove your knowledge in the chosen industry and to do it reasonably.
