Permanent residence permit

We continue to consider residence permits in the Netherlands in more detail. We remind you that you can see our review article about them here.

But first, a few words about terms. In Russian, the abbreviation "residence permit" is often used, which stands for "residence permit". H1 And what, in this case, "permanent residence"? A similar decoding says that this is a "permanent residence". Are these two concepts related? Yes, it is quite. Residence permit includes both temporary and permanent residence permits. And the permanent place of residence (permanent residence) is the address in the country or the country where you live permanently (i.e. officially registered on an indefinite basis and have the corresponding document), regardless of whether you are a citizen of this country or (perhaps still) no. In other words, while on permanent residence in the Netherlands, you can have both a passport of a citizen of this Kingdom and a permanent residence permit, which we will now talk about.

So, you have already lived in the Netherlands for at least 5 years (for example, with a Type I temporary residence permit), and you want to continue to live here permanently. And it is in this case that you can apply for a residence permit for an indefinite period, which is also called "long-term", "indefinite" or "permanent" residence permit. In Dutch it sounds like verblijfsvergunning (regulier) voor onbepaalde tijd / verblijfsdocument onbepaalde tijd / duurzaam verblijf.

Long-term resident of the EU

In this matter, we could not fail to mention the status of "long-term resident of the EU", the possibility of obtaining a residence permit for which is checked initially by default when you apply for a permanent residence permit in the Netherlands.

Having a residence permit for a long-term resident of the EU will subsequently (if necessary) make it easier for you to apply for a residence permit in one of the other EU countries that also have this type of permission. But for this you must meet the conditions that exist in this country to obtain a residence permit there.

In case you already have a permanent residence permit in the Netherlands, you can also apply for a long-term residence permit (residence) in the EU.

You can familiarize yourself with the conditions for obtaining a residence permit specifically for a long-term resident of the EU here. We will only consider the conditions for obtaining a permanent residence permit in the Netherlands.

General conditions for obtaining a residence permit in the Netherlands

First, let's dwell on the conditions for obtaining a residence permit, applicable to all types of residence permits, and they are as follows:

  1. You have a valid identity document that allows you to cross the border, such as a passport. The child can be entered in the passport of one of the parents.
  2. You fill out and sign a special application form Antecedentverklaringin which you provide information about your criminal history, for example, you indicate that you have not committed any crimes. You also represent that you have not provided incorrect information or acted unlawfully in the Netherlands. Children under 12 do not need to fill out this document.
  3. Upon arrival in the Netherlands, you will undergo a medical examination for tuberculosis (tuberculose - tbc) within 3 months.

You are relieved of this in one of the following situations:

  • You are a citizen of one of the countries indicated here.
  • You already have a valid residence permit in the Netherlands and are applying for another residence permit.
  • You were born in the Netherlands and have always lived here.
  • Less than 6 months ago, you were already tested for tuberculosis in the Netherlands.
  • You have an EU residence permit for a long-term resident issued by another EU country, or you are a family member and live with a long-term resident in another EU country.

Note! Official foreign documents must be legalized or apostilled and translated into Dutch, English, French or German.

 

Conditions for obtaining a permanent residence permit in the Netherlands

Now let's consider the conditions, in addition to the general ones, that are necessary to obtain a permanent residence permit in the Netherlands:

  • Immediately before applying, you had a valid residence permit in the Netherlands for a period of 5 years or more, for which only those years when you are 8 years old are taken into account. Therefore, you can only apply for a permanent residence permit if you are at least 13 years old, have lived in the Netherlands since 8 years old and have a valid residence permit. As an exception, this period of 5 years may not apply in the cases listed here.
  • You have always met the conditions of your residence permit, and you still meet them.
  • You have (optional) a valid residence permit for a non-temporary purpose (residence permit for a did not-temporary Doel)
  • You have permanently resided in the Netherlands for 5 years prior to applying for a permanent residence permit. This means that you have had a valid residence permit for all these 5 years, you applied for its extension / change on time, and during this time you did not move from your main place of residence outside the Netherlands.
  • You are registered in the database of personal records of residents of the Netherlands (Basisregistration Adults - BRP) in your municipality (municipalitye) at the place of residence. You do not need to attach any documents to confirm this - service Immigration- en naturalization service-IND independently checks if you meet this condition.
  • You have an independent, sufficient and stable income.
  • You have passed the required exams and received an integration diploma (inburgering diploma), which shows that you are sufficiently able to read, write, speak and understand Dutch. In some cases, you do not need to take an integration examThere are exceptions to these conditions if you are an adult, were born in the Netherlands or came to live in the Netherlands before you were 3 years old and have resided permanently in the Netherlands since then. Your application for a permanent residence permit can only be rejected for reasons of public order or national security. All other conditions mentioned above do not apply to you.

The structure of the application for a permanent residence permit and the requirements for the attached documents

An application for a permanent residence permit in the Netherlands is submitted by you to the service Immigration- en naturalization service-IND according to the established Form 6009, which is called Request for a EU residence permit for long lasting ingezetenen of a residence permit regular for onbepaalde time, and you can watch it and, if necessary, download here.

If the document is sent by mail, it must be printed and filled in with either a hard-soft (HB) pencil or a pen with a black or blue core in block letters. The filling language is Dutch, and the spelling is the same as indicated in your passport from the homeland / country of previous residence, in a valid residence permit and in other documents in the Netherlands.

This document is composed of six parts and has a total of 30 pages. Look carefully - if you are not an entrepreneur in the Netherlands, then part 7112-02 Appendix Declaration omtrent income independent entrepreneur you do not need to fill out and send as part of the kit. Or if you are not working under an employment contract, then part 7110-02 Appendix Employer's declaration you will also be absent, because it is completed by your employer. A part 7111-04 Appendix Bewijsmiddelen income for you - only for informational purposes, there is nothing to fill out in it, and it is not included in the set of documents for the application. But it is in this part that it says copies of which documents you must attach to the application package for a permanent residence permit, depending on your specific situation.

Pay attention! Service Immigration- en naturalization service-INDmay, in addition to those specified in Form 6009, ask you to provide other documents - be prepared for this.

The general requirements for documents provided in IND, the following:

  • you send only copies of your documents, one-sided and in A4 format;
  • copies must be complete and legible;
  • special issued to you V-number must be written on each copy; if you do not know him, then write your name and date of birth on each copy (you can write this information with a pen with a black rod in the upper right or lower right corner on each page of the attached copies);
  • do not send USB sticks, CDs or DVDs;
  • you must keep the originals of the documents yourself and show them directly at the reception in IND in the event of such a request.

The procedure for applying for a permanent residence permit and payment for its consideration

Send online

You can apply for a permanent residence permit digitally (online). This can be done starting from 3 months before the expiration of your current residence permit and up to the last date of its validity. To fill out the application digitally, you will need:

  • DigiD with code SMS
  • iDEAL (Internet banking) to pay for the consideration of your application.

The application itself in electronic form has 6 steps, the last of which will be the payment of the fee for submitting this application for consideration, and only after that the sending of the application will be completed.

Sending by mail

Have you decided to submit a paper form? Of course, this is possible - the choice is yours, but please do not delay - the period of 3 months before the expiration of your current residence permit will fly by very quickly. But this is also the only option if your current residence permit has already expired - then you will no longer be able to submit a digital application.

You send a full package of documents (the application itself and its attachments) to the address IND by mail, upon receipt of which IND will send a letter to your address indicating the procedure for paying the fee for considering your application - be sure to pay on time for the details specified in the letter, because only after that your application is accepted for consideration.

Pay attention! If you have been residing in the Netherlands continuously and legally for more than 5 years and meet the conditions for applying for a residence permit for an indefinite period, then you can apply at any time. In other words, you don't have to wait for your current residence permit to expire.

Payment for consideration

The cost of applying for a permanent residence permit (fee) for adult applicants is 192 euros, for minors - 64 euros.

A cost exception was made for Turkish citizens: for adults it is 64 euros, for minors - 33 euros.

Please note that in the event of a negative decision on your application, the amount paid for this fee will not be refunded.

Pending a decision and monitoring the application

After IND will receive your application with a package of documents, you will definitely receive from IND a reply letter confirming this receipt. This letter indicates the date on which IND received your application and the period of time that has IND to assess your application and your situation. This is called the decision-making period, which, for a permanent residence permit, usually lasts up to 6.

After you receive a reply letter from IND, you may need to make an online appointment with the department IND for submission of biometric data - passport photos, your signature and fingerprints.

INDUpon receipt of your application, it initially checks that all required application pages have been completed and that you have paid the fee. After that, a detailed examination of all applications takes place and it is determined which documents are missing or, perhaps, some of them are incorrect or raise doubts. Due to this IND will send you another (maybe more) letter with an additional request for the documents listed in this letter - you need to send them to the IND before the date indicated in the letter.

Follow your application on the website in Mare IND... If you have also registered in the mailbox Message box MyGovernment and entered your email address, then you will receive an email through the "Message" field when a new email from IND.

Decision-making

IND checks if you meet all the necessary conditions and reviews your documents. According to the law, in this case, this period is up to 6 months, during which:

  1. IND first checks if you meet the conditions for obtaining a residence permit as a long-term resident of the EU (Type V).
  2. If you do not fit these conditions, then IND will automatically check if you qualify for a permanent residence permit (Type II). You do not need to submit a separate application for this.
  3. If you do not fit the previous conditions, then IND will automatically check if you qualify for the renewal of your current temporary residence permit (Type I). You do not need to submit a separate application for such an extension.

After all the checks listed above, you will receive a decision on your application.

  • Negative decision

If you do not meet the conditions for all 3 options, then you will not receive a residence permit. This is contained in a letter titled "Solution" (beschikking).

  • Positive decision

If all the conditions are met, you will receive a residence permit (long-term resident of the EU or for an indefinite period or extension for a specific period). About it IND should inform you by letter. Congratulations!

Obtaining a residence permit in the Netherlands

You will find out when you will be able to obtain a residence permit from the letter that came to your address. After receiving it, you must make an online appointment at the department IND... And already being in IND, be sure to check if the information on your residence permit is correct. If some data is incorrect, then immediately inform the employee about it IND.

An indefinite residence permit gives you the right to reside permanently in the Netherlands. This means that your right to reside in the Netherlands remains valid even if your residence document expires. The residence permit is always issued for 5 years and can be renewed at any time thereafter.

Work

Whether you can work in the Netherlands is always indicated on the back of your residence permit. With a permanent residence permit (Type II or Type V), you can work freely in the Netherlands and your employer does not need to have a work permit for you to employ foreign nationals (tewerkstellingsvergunning-TWV)... Your residency document states: 'Work free Allowed, TWV did not vereist'.

You can continue to work if your residence permit has expired. In the event that an administrative authority asks for proof of your legal residence, you can request a letter under Article 9 (article 9) in the department INDby making an appointment for this online.

Rights and obligations

With a residence permit for a “long-term resident of the EU” or “for an indefinite period”, you have almost the same rights as a person with Dutch citizenship. The main differences are that you are not allowed to vote in national elections and you are not allowed to work in certain special (government) sectors (for example, the police or the army). For this to be possible, you must first apply for Dutch citizenship.
